Description
Die Erfindung bezieht sich auf ein Datenverarbeitungssystem
zur Realisierung und Aufrechterhaltung eines automatisierten
und geordneten Wertpapiermarkts für den Handel mit einem oder
mehreren Wertpapieren der im Oberbegriff des Anspruchs 1 genannten
Gattung.
Eine solche Datenverarbeitungsanlage zur Bestimmung von Kursen und
Abwicklung von Aufträgen für fungible Güter auf einer Börse
ist bekannt aus CH 544 347. Der hier beschriebene Kursrechner
für Produkte, Effekten und ähnliche Börsen soll die Handels
kurse für jede fungibler Güter auf einer Börse bestimmen,
ohne daß es dazu menschliches Urteilsvermögen bedarf. Haupt
aufgabe dieses Systems ist es daher, eine automatische Kursbe
stimmung auf einer Börse zu ermöglichen und eine vollständige
laufende Aufzeichnung aller Kaufs- und Verkaufsaufträge wie
auch der abgewickelten Geschäfte zu erhalten.
Ferner ist ein Datenverarbeitungssystem zum automatischen Ausgleich
von Kauf- und Verkaufsaufträgen für eine Mehrzahl von Wertpapieren
bekannt aus US 44 12 287; es leistet jedoch nicht die Auf
rechterhaltung eines automatisierten und geordneten Wertpapier
marktes.
Es gibt verschiedene Arten des Kaufens oder Verkaufens von
bzw. des Handels mit Wertpapieren, z. B. mit Stammaktien. Ab
gesehen von privaten Transaktionen zwischen Parteien erfolgt der
Handel mit aktien typischerweise an einer nationalen oder re
gionalen Börse bzw. im Freiverkehr. Sowohl für den Börsen- als
auch den Freiverkehrshandel gibt es einen oder mehrere Händler/
Makler ("amtliche Kursmakler" an der Börse), die die Handels
wünsche von Käufern und Verkäufern von Wertpapieren, mit denen
sie handeln, annehmen und ausführen.
Aufgabe der vorliegenden Erfidnung ist die Bereitstellung eines
Datenverarbeitungssystems,
zur verbesserten Automatisierung des Wertpapiermarktes, damit der
als Prinzipal tätige Systemanwender auf einfache Weise schnell
Entscheidungshilfen vom System erhält.
Die Erfindung ist im Anspruch 1 gekennzeichnet und in Unter
ansprüchen sind weitere Verbesserungen beansprucht.
Die vorliegende Erfindung ermöglicht dem Systemanwender die
Kontrolle seines Engagements bzw. seines Bestands von Wertpapieren
und bietet ihm als "Marktmacher" nicht nur eine gute Verknüpfung
mit den kursebestimmenden Börsen einerseits, sondern auch mit
anderen Korrespondenzpartnern, wie anderen "Marktmachern",
an insbesondere weiter entfernten Standorten andererseits.
Darüber hinaus gestattet das erfindungsgemäße Datenverarbeitungs
system dem Anwender Übersichtsmöglichkeiten seines eigenen
Markts auf "Echtzeitbasis", was für solche "Marktmacher" besonders
wichtig ist, damit die von dem Systemanwender unterhaltenen
Märkte nicht zusammenbrechen und hierdurch womöglich wesentlich
auch andere übergeordnete Märkte beeinträchtigen. So hat der
Systemanwender (Makler) mit der hier vorliegenden Erfindung
stets und unverzüglich alle wichtigen Informationen für die
Abwicklung von Geschäften mit anderen Systemanwendern der Börse
oder Kunden. Diese "maschinelle" Hilfe erspart ihm zeitraubende
mühselige und oftmals auch stark fehlerbehaftete eigene Unter
suchungen. Das System überwacht automatisch den effektiven
Bestand und Gewinn/Verlust des Systemanwenders und kontrolliert
automatisch die Position des Prinzipals. Bei der Position handelt
es sich hierbei um den Umfang der Anteile (momentanes Engagement)
jeder Aktie, die vom Systemanwender gehalten wird. Eine solche
Position ist also der Bestand bzw. das Engagement des Prinzipals
am betreffenden Wertpapier bezogen auf den Kurswert beim Kauf
und zum jeweiligen Zeitpunkt. Die durchschnittliche Position
des Prinzipals ergibt sich daher bei jeder Aktie aus den An
kaufskosten multipliziert mit der betreffenden Aktienanzahl
über eine bestimmte Zeit im Vergleich zum Preis (zu einem be
stimmten Zeitpunkt) multipliziert wieder mit der Anzahl der
gehaltenen Aktien. Im Ergebnis wird ein Gewinn oder Verlust
für den Prinzipal erwirtschaftet.
Das System ruft die besten Geld- und Briefkurse des Tages ab bzw.
speichdert sie; es qualifiziert Kauf- bzw. Verkaufsaufträge von
Kunden zur Ausführung; es führt die Aufträge aus; und es listet
die Geschäftsdetails für Kunden und für nationale Aktienkurs-
Berichtsysteme auf. Die Einrichtung bestimmt und überwacht ferner
den Aktienbestand und den Gewinn des Händlers/Maklers.
Die Grundsätze der vorliegenden Erfindung sind gleichermaßen
auf den Wertpapierhandel in jedem Markt anwendbar, in dem der
Makler als Auftraggeber tätig ist, d. h. indem er Kauforders
von Kunden ausführt durch Verkauf des Wertpapiers aus seinem
Bestands-Engagement (Hausse oder Baisse) oder kauft, um ein
Hausse-Engagement zu erhöhen, oder in Erfüllung von Verkaufs
orders von Kunden ein Baisse-Engagement reduziert. Nur für
die Zwecke der Erläuterung wird im vorliegenden Fall als
Diskussionsgrundlage von Freiverkehrsgeschäften ausgegangen,
da die größte Anzahl Stammaktien auf dieser Grundlage gehandelt
wird und große Brokerfirmen ungehindert einen geordneten Markt
für ausgewählte frei gehandelte Aktien in Gang halten können
und dies häufig auch tun, während sie in ihren Möglichkeiten
zum Inganghalten eines geordneten Marktes für an einer Börse
notierte Papiere durch Börsenbestimmungen eingeschränkt sind.
Die vorstehende Aufgabe wird gmeäß der Erfindung gelöst durch
eine spezielle, auf Datenverarbeitung basierende Einrichtung,
die einen geordneten Markt für ein oder mehrere Wertpapiere
in Gang hält. Die Einrichtung ruft die besten momentanen Geld-
und Briefkurse von einer entfernten Datenbank ab, die für eine
Gesamtheit von Institutionen oder andere, die für die ent
sprechenden Wertpapiere einen geordneten Markt in Gang halten,
zur Verfügung steht. Der Einrichtung wird Information, die
für jede von einem Kunden verlangte Wertpapierkauf- bzw. -verkauf
order charakteristisch ist, zugeführt. Die Order wird durch
Vergleich ihrer spezifischen Inhaltsfelder mit vorbestimmten
gespeicherten Parametern zur Ausführung qualifiziert. Die
gespeicherten Parameter umfassen z. B. die gültigen Tagesgeld-
und -briefkurse, die Aktienmenge, die für Kundenkäufe bzw.
Kundenverkäufe zur Verfügung steht, sowie den maximalen an
nehmbaren Umfang von Einzelorders.
Wenn die Order qualifiziert ist, wird sie ausgeführt, und die
entsprechenden gespeicherten Parameter werden aktualisiert.
Die Einrichtung liefert eine Bestands- bzw. Engagementkontrol
le sowie Gewinnbuchführung für den Makler. Schließlich listet
die Einrichtung die Einzelheiten des ausgeführten Geschäfts
für den Kunden sowie für nationale Aktienkurs-Berichtssysteme
auf. Bei einer Änderung des notierten Kurses für ein Wertpa
pier aktualisiert die Einrichtung alle relevanten Orderquali
fizierungs-Parameter.
An Hand der Zeichnung wird die Erfindung beispielsweise näher
erläutert. Es zeigt
Fig. 1 das Blockschaltbild der Einrichtung nach der
Erfindung zur Durchführung der Wertpapierge
schäfte;
Fig. 2 ein Ablaufdiagramm, das die Datenverarbeitung für
die Qualifizierung einer Order zur Ausführung
derselben verdeutlicht;
Fig. 3 ein Ablaufdiagramm, das die Datenverarbeitung für
die Ausführung und Abrechnung einer Order zeigt;
Fig. 4 und 4A Ablaufdiagramme, die die Datenverarbeitung für
die Aktualisierung des Bestands und des Gewinns
verdeutlichen; und
Fig. 5 ein Ablaufdiagramm, das die Datenverarbeitung bei
einer Änderung des Kurses eines Wertpapiers im
Freiverkehr zeigt.
Im vorliegenden Zusammenhang beziehen sich die Ausdrücke "kaufen"
und "verkaufen" auf Kundenkäufe und -verkäufe. Es ist zu be
achten, daß beim Kauf von Aktien durch einen Kunden der Makler
Aktien aus seinem Engagement verkauft, wobei er entweder ein
Hausse-Engagement vermindert, ein Baisse-Engement erhöht
oder beides tut, wenn die Anzahl Anteile, die an den Kunden
verkauft werden, das ursprüngliche Hausse-Engagement übersteigt.
Wenn ein Kunde Aktien verkauft, fügt der Makler seinem Engegement
Aktien hinzu und/oder verringert ein Baisse-Engagement in diesem
Wertpapier.
Das System ist mit irgendeiner digitalen Datenverarbeitungs
einrichtung realisierbar, die dem Fachmann an sich bekannt
ist, die z. B. Bus-System aufweist, an das ein digitaler
Prozessor, manuelle Dateneingabe-Terminals, ein oder mehrere
Speicher (von denen einer das Steuerprogramm enthält) sowie Aus
gabesignalgeräte, wie ein Bildschirm und ein Drucker ange
schlosen sind. Das System kann in irgendeiner an sich bekannten
Programmiersprache codiert sein. Die Prozeßvariablen können
irgendeine Form aufweisen, die den Beschränkungen der jeweils
verwendeten Sprache entspricht, und die nachstehend angeführten
Variablen sind nur beispielsweise angegeben.

Fig. 1 zeigt in Gesamtübersicht ein System zur Realisierung
des Freiverkehrs- (oder anderen) Aktienmarksystems nach der
Erfindung. Zur besseren Erläuterung, jedoch ohne Einschränkung,
wird von Freiverekehrsgeschäften ausgegangen, und ferner
wird angenommen, daß die einen geordneten Markt in Gang haltende
Institution (der Systemanwender) eine Brokerfirma ist.
Das System umfaßt eine digitale Verbundrecheneinrichtung 10
mit Prozessor und peripherem Speicher. Die Speicherbestandteile
des Prozessors 10 speichern das Systemsteuerungsprogramm,
und ein geeigneter Notizblockspeicher speichert sämtliche
erforderlichen Bearbeitungsoperanden. Der Digitalrechner
10 ist über eine Ausgangsleitung 12 mit einem Kundenkonten-
Prozessor 13, z. B. dem Rechner der Brokerfirma, gekoppelt,
der sämtliche Kundenkontenaufzeichnungen und -dateien ein
schließlich Guthaben, Wertpapier-Engagements, Handelsaufzeich
nungen der Kunden u. dgl. bearbeitet. Es ist zu beachten, daß
die CPU 10 und der Kundenkontenprozessor 13 auch in einer
einzigen integrierten Recheneinrichtung kombinierbar sind.
Der Prozessor 10 ist über eine Verbindungsleitung 11 mit einem
Händlerterminal 15 gekoppelt, das eine Ausgabesignal-Einheit
wie etwa eine Bildschirmanzeige sowie eine Dateneingabevor
richtung wie etwa eine Tastatur aufweist. Das Händlerterminal
15 besteht aus zwei Teilen. Ein Terminalteil T1 steht mit dem
Prozessor 10 in Verbindung, und ein Terminalteil T2 ist über
eine Verbindungsleitung 16 mit dem NASDAQ-System 18 gekoppelt
(NASDAQ-System = bundesweiter Handel in Freiverkehrswerten,
basiert auf einem elektronischen System der National
Association of Securities Dealers). Das Händlerterminal 15
übermittelt - ebenso wie andere, auf Leitung 17 eingespeiste
Makler - auf der Verbindungsleitung 16 seine laufenden Geld-
und Briefkurse für Aktien, mit denen der Makler handelt. Die
Terminalteile T1 und T2 können auch eine integrierte intelligente
Terminal- bzw. Rechnereinheit sein oder aus zwei getrennten
Vorrichtungen bestehen, die dem Händler an der Station
15 zur Verfügung stehen.
Der Prozessor 10 empfängt und speichert den besten (höchsten)
Geldkurs (Verarbeitungsvariable BSTB(STK)) für jede Aktie
(STK), für die ein geordneter Markt in Gang gehalten wird, und
den besten (niedrigsten) Briefkurs (BSTA(STK) von dem NASDAQ-
System 18 über eine Verbindungsleitung 22. Die besten Geld-
und Briefkurse entsprechend der Information vom NASDAQ-System
bilden den sogenannten Insider-Markt für im Freiverkehr gehandelte
Wertpapiere. Der Prozessor 10 teilt dem NASDAQ-System 18
über eine Verbindungsleitung 23 jedes berichtsfähige aus
geführte Geschäft für verschiedene Informations- und Regulie
rungszwecke mit. Die Verbindungsleitung 23 übermittelt auch
Geschäfte an die Consolidated Tape Authority (CTA) und das
nationale Marktsystem (NMS) der National Association of
Securities Dealers zur anschließenden Weiterleitung an die
Finanzwirtschaft und die Öffentlichkeit. Die Verbindungsleitung
23 koppelt ferner den Prozessor 10 mit dem Kleinorder-
Ausführungssystem (SOES) und dem rechnergestützten Ausführungs
system (CAES) der National Association of Securities
Dealers, wobei diese beiden Systeme sich an der Ausführung
relativ kleiner Orders beteiligen können.
Ein Eingabe/Ausgabe-Leitungsnetz 25 sorgt für die Datenver
bindung mit den verschiedenen Zweigstellen 27 der Brokerfirma.
Das Leitungsnetz 25 erlaubt die Verbindung entweder mit dem
Angestellten der Zweigstelle für den Auftragseingang oder
direkt mit den angestellten Brokervertretern in jeder Zweigstelle.
Fig. 1 zeigt zwar nur eine Zweigstelle 27₁, aber
selbstverständlich steht eine Vielzahl Zweigstellen 27 i mit
dem Prozessor 10 in Datenverbindung. Der Prozessor 10 steht
ferner mit dritten Finanzhäusern 29 i (z. B. auch INSTINET)
über eine doppeltgerichtete Datenverbindungsleitung 26 in
Verbindung.
Insgesamt ist die Einrichtung nach Fig. 1 wie folgt zu charak
terisieren: Die gültigen Kurse (bester Geldkurs, bester Briefkurs
auf dem Freiverkehrsmarkt) für jedes Wertpapier, für das
der Systemanwender einen geordneten Markt in Gang hält, werden
über die Verbindungsleitung 22 vom NASDAQ-System übermittelt
und im Speicher des Prozessors 10 gespeichert. Der Makler hat
in jedem Wertpapier, für das er einen geordneten Markt in Gang
hält, ein Engagement, und die Einzelheiten dieses Engagements
befinden sich ebenfalls im Speicher des Verbundprozessors 10.
Aufträge für Geschäfte mit den relevanten Wertpapieren werden
auf Echtzeitbasis bei Auftreten zum Prozessor 10 weiter
geleitet. Aufträge können auf verschiedene Weise empfangen werden.
Charakteristisch werden Aufträge z. B. von Brokervertretern
der Brokerfirma an den Zweigstellen 27 erzeugt und über das
Leitungsnetz 25 zur CPU 10 übermittelt. Aufträge werden dem
Prozessor 10 ferner von dritten Finanzinstitutionen 29 (z. B.
anderen Brokerfirmen, direkt von über Computer verfügenden
Kunden, von Banken od. dgl.) auf der Datenübertragungsleitung
26 zugeleitet. Jeder Auftrag umfaßt geeignete Datenfelder, die
vorstehend umrissen wurden und nachstehend noch im einzelnen
erläutert werden, wie etwa eine Kennzeichnung des Büros oder
des Kunden oder sonstigen Auftraggebers, die Wetpapierkenn
zeichnung, Kurseinzelheiten usw.
Der Prozessor 10 entscheidet zuerst, ob jeder Auftrag aus
geführt werden kann, d. h. er "qualifiziert" den Auftrag. Es
gibt verschiedene Gründe, weshalb ein Auftrag vom Makler nicht
ausgeführt wird. Zum Beispiel kann der Kunde wünschen, Wertpapiere
über dem momentanen Geldkurs zu v erkaufen oder ein Wertpapier
unter dem momentanen Briefkurs zu kaufen. Ein Kunde kann den
Verkauf einer Anzahl Anteile wünschen, die über den Umfang
hinausgeht, den der spezielle Makler entweder insgesamt oder
für irgendeinen Einzelauftrag annehmen möchte. Nicht ausführbare
Aufträge, d. h. nichtqualifizierte Aufträge, werden entweder
im Speicher des Prozessors 10 gespeichert und später
ausgeführt, wenn sie noch qualifiziert werden (etwa durch eine
günstige Kursänderung eines Wertpapiers, so daß dann die
Preislimitierung des Kunden eingehalten werden kann), oder sie
werden auf den Nachrichtenleitungen 23 oder 26 an andere
Makler zur potentiellen Ausführung weitergeleitet.
Angenommen, daß ein Auftrag ausführbar ist, führt der Prozessor
10 den Auftrag unter entsprechender Anpassung aller Salden
aus. Den ausgeführten Auftrag charakterisierende Information
wird dem Rechner 13 für Kunden dieser Brokerfirma zugeführt
oder der jeweiligen anderen Institution über die Verbindungs
leitungen 23 oder 26 berichtet. Die Einzelheiten geeigneter
Transaktionen werden ferner an die NASD für Informationszwecke
sowie an die Consolidated Tape Authrity usw. weitergegeben
und können zu Eingabe in den Kursanzeiger der Börse in New
York führen.
Dem NASDAQ-System 18 werden die laufenden Notierungen von
sämtlichen Maklern, die für die jeweiligen Wertpapiere einen
geordneten Markt in Gang halten, auf der Übertragungsleitung
16 zugeführt. Die Freiverkehrsnotierungen (beste Geld- und
Briefkurse) werden dem Prozessor 10 des Maklers über die Ver
bindungsleitung 22 mitgeteilt. Wenn sich die Freiverkehrs
notierung ändert (eine Änderung des besten Geld- oder Briefkurses
eintritt), informiert der Prozessor 10 den Händler an der
Station 15, der dann die Möglichkeit erhält, seine Menge oder
andere markt-charakteristische Kriterien neu anzupassen. Nach
jeder Notierungsänderung werden alle nichtausführbaren Orders,
die im Speicher des Prozessors 10 gespeichert sind, erneut
geprüft, und es wird entschieden, ob sie nunmehr ausführbar
geworden sind; wenn dies der Fall ist, werden sie ausgeführt.
Die Verarbeitung geht dann in der vorstehend erläuterten Weise
weiter, um den Echtzeit-Ordereingang abzuarbeiten.
Unter Berücksichtigung der vorstehenden Gesamtübersicht wird
nunmehr auf Fig. 2 Bezug genommen, die ein Ablaufdiagramm der
Datenverarbeitung für die Ausführungs-Qualifizierung einer
Order zeigt, die von einem Auftragsannahme-Angestellten einer
Zweigstelle oder einem Brokervertreter 27 i übermittelt wird.
Ausgehend vom Startpunkt 50 werden die Datenfelder für diese
als nächste aufgezeichnete Order eingegeben (Block 51). Die
Order-Datenfelder umfassen die Bezeichnung der Aktie (STK),
die Anzahl Anteile für die Transaktion (NSH), die Kunden
identifikation (CUSTID), ein Kauf/Verkauf-Bit (B/S), die Limi
tierung, falls der Kunde eine solche wünscht, oder andernfalls
eine Bestensauftrag-Bezeichnung (PR/M), gegebenenfalls spezielle
Anweisungen (SP), eine Ordernummer (RN) sowie eine
Herkunftskennzeichnung (RIGID) (z. B. Büro, Börsenvertreter
oder dritte Institution).
Der Rechner enthält eine Anzahl von gespeicherten Variablen,
die den Markt für die Aktie STK, die der Kunde handeln will,
charakterisieren, und ferner die eigenen Kriterien des Maklers
für seine Teilnahme an dem STK-Geschäft. Zum Beispiel speichert der
Rechner den besten Geldkurs BSTB(STK), den besten Briefkurs
BSTA(STK), den Kaufumfang BSZ(STK), d. h. die Gesamtmenge
Anteile von STK, die der Makler an Kunden zum laufenden Kurs
verkaufen will, den Verkaufsumfang SSZ(STK) des Maklers, den
maximalen Einzelorderumfang für die Aktie STK, den der Makler
akzeptiert RSZ(STK), die momentane Anzahl Aktienanteile STK
auf Hausse- oder Baisse-Basis im Engagement des Maklers
PS(STK) - dabei ist das Hausse-Engagement positiv und das
Baisse-Engagement negativ -, die Durchschnittskosten pro
Anteil AVCST(STK) für das auf Hausse- oder Baisse-Basis im
Portefeuille des Maklers befindliche Wertpapier STK, und einen
laufenden Gewinngesamtbetrag PR(STK) des Maklers für das Wert
papier STK. Der nächste Block 53 entscheidet, ob die Order-
Abarbeitung für das spezielle Wertpapier STK im normalen auto
matischen Feihandelsmodus erfolgt. Wenn nicht (vgl. auch Fig.
5), zweigt der Programmablauf zu Block 54 ab und speichert die
Order für späteren Abruf oder manuelle Ausführung. Der Pro
grammablauf kehrt dann zum Startpunkt 50 zurück und ruft die
nächste Order ab. Unter der Annahme der Abarbeitung im normalen
automatischen Modus (J-Ausgang der Prüfung 53) geht der
Programmablauf zur Prüfung 55 weiter, wo die Eingangsinformation
(Order) auf richtigen Empfang und interne Übereinstimmung
geprüft wird. Wenn ein Fehler aufgetreten ist, wird eine
Fehlernachricht erzeugt (Block 56), und der Programmablauf
kehrt zum Startpunkt 50 für die Eingabe der nächsten einlaufenden
Order zurück. Im Normalfall wird die Order bei der
Prüfung 55 geprüft, und der Programmablauf geht zu Block 67
weiter, wo entschieden wird, ob die Order eine Freiverkehrsorder
oder limitiert ist (Prüfung der PR/M-Variablen).
Wenn die Order keine Freiverkehrsorder ist, sondern zu einem
vom Kunden angegebenen Preis oder besser auszuführen ist
(N-Zweig von Prüfung 67), geht der Programmablauf zu Block 69,
der eine Kundenkauforder (B/S=B) von einer Verkauforder
(B/S=S) unterscheidet. Wenn es sich um eine Kauforder (J-
(kaufen)-Zweig von Prüfblock 69) handelt, entscheidet Block
70, ob der Kurs, zu dem die Order auszuführen ist (Inhalte von
PR/M) höher als der momentane Briefkurs (BSTA(STK)) der Aktie
oder gleich diesem ist. Wenn der Kaufpres der auszuführenden
Order h öher als der beste Briefkurs ist (J-Zweig von Block
70), entscheidet Block 72, ob die Anzahl Anteile NSH im
Verkehr kleiner oder gleich der Anzahl Anteile ist, die vom
makler für Käufe verfügbar ist, d. h. kleiner als der Kaufumfang
BZS(STK). Wenn dies der Fall ist (J-zweig des Prüfblocks
72), wir die Anzahl Anteile NSH der Transaktion mit
der maximalen annehmbaren Einzelordergröße RSZ(STK) verglichen
(Schritt 90). Angenommen, daß dieses letzte Kriterium
erfüllt ist (N-Ausgang), wird die Order zur Ausführung qualifiziert,
und der Programmfluß geht zu Block 92 weiter, wo eine
das letzte Engagement in der Aktie STK speichernde Variable
LPS(STK) gleich PS(STK) gesetzt wird. Dann geht das
Programm zur Orderausführung entsprechend Fig. 3 weiter.
Wenn die in Block 70 und Block 72 ausgeführten Kurs- oder
Kaufumfang-Prüfungen negativ sind (N-Zweig), oder wenn die in
Block 90 durchgeführte Orderumfangprüfung ergibt, daß die
Order zu groß ist (J-Zweig), wird die Order nicht zur Ausführung
qualifiziert und nicht ausgeführt. Wenn irgendeine dieser
Bedingungen vorliegt, zweigt der Programmablauf zu Block 86 ab
und speichert die Order für eine mögliche spätere Ausführung,
falls sich die Handelsbedingungen oder die Kriterien des
Maklers ändern. Ein entsprechender Bericht wird in Block 88
über das Terminal 15 (Fig. 1) erzeugt, um die nichtausgeführte
Order zu charakterisieren. Dann geht der Programmfluß zum
Punkt 50 zurück, um die nächste empfangenen Order abzuarbeiten.
Der menschliche Geschäftssystem-Kontrolleur, der den Bericht
erhält, kann diesen selbstverständlich ungültig machen und das
Geschäft durch Handeingabe oder manuelle Eingabe ausführen,
z. B. durch die Autorisierung von mehr Bestand (Erhöhen von
BSZ(STK)), wenn dieses Kriterium die Orderausführung blockiert
hat.
Bei der vorstehenden Erläuterung handelt es sich um eine limitierte
Kauforder. Nachstehend wird unter Rückkehr zu Block 69
der Programmablauf für einen Kundenverkauf erläutert. Wenn das
Kauf/Verkauf-Bit einen Verkauf anzeigt, zweigt der Programmfluß
zum Block 82 ab, wo das PR/M-Preislimit mit dem besten
Geldkurs verglichen wird (PR/mBSTB(STK)). Wenn die Antwort
Ja ist (J-Zweig), wird die Anzahl Anteile NSH der Order mit
dem verfügbaren Verkaufsumfang verglichen (NSHSSZ(STK)).
Wenn im Verkaufsumfang ausreichend Anteile vorhanden sind
(J-Zweig), entscheidet Block 90, ob die Anzahl Anteile
(NSH) größer als der höchstzulässige Einzelorderumfang
(RSZ(STK)) ist. Wenn die Anzahl NSH der Anteile
RSZ(STK) nicht übersteigt, sind sämtliche Kriterien erfüllt,
und die Verkaufsorder wird ausgeführt. Das Programm
geht zu Block 92, wo die "letzte" Engagementvariable
LPS(STK) gleich PS(STK) gesetzt wird, und die Ausführung
der Order geht entsprechend Fig. 3 vor sich. Wenn eine der
Kurs- oder Verkaufsumfang-Prüfungen in den Blöcken 82 oder 90
negativ ist, zweigt das Programm zum Block 86 ab, wo Speicherung
und Berichterstellung (Block 88) erfolgt.
Fig. 3 zeigt den Verarbeitungsablauf für die Ausführung und
Abrechnung von Order, die durch die Orderqualifizierung gemäß
dem Ablauf von Fig. 2 zur Ausführung qualifiziert wurden. Ein
Block 110 entscheidet, ob die Order ein Kundenkauf oder
-verkauf ist. Wenn das Kauf/Verkauf-Bit eine Kundenkauforder
bezeichnet, zweigt das Programm zu Block 112 ab, wo die für
Kundenkäufe vom Makler noch verfügbar bleibende Menge an
Anteilen (SSZ(STK)) verringert wird. SSZ(STK) wird um die
Anzahl Aktienanteile (NSH), die vom Kunden gekauft wurden,
verringert, also SSZ(STK) = SSZ(STK) - NSH. Das Engagement
des Maklers in dieser Aktie wird algebraisch um die Anzahl
gekaufter Anteile vermindert, PS(STK) = PS(STK) - NSH
(Schritt 115). Wenn im Block 110 entschieden wird, daß es sich
um eine Verkaufsorder handelt, verringert Block 116 den Kaufumfang
BSZ(STK) um die Anzahl Anteile, die an den Kunden verkauft
wurden, also BSZ(STK) = BSZ(STK) - NSH. Das Engagement
des Maklers PS(STK) in dieser Aktie wird aktualisiert
durch algebraische Erhöhung der Anzahl Anteile, die vom Kunden
verkauft wurden, PS(STK) = PS(STK) + NSH (Schritt
119).
Nachdem die das Engagement PS(STK), den Kaufumfang BSZ(STK)
und den Verkaufumgang SSZ(STK) betreffenden Variablen aktualisiert
sind, geht das Programm zu Block 122 weiter, wo dem
Kundenkontenprozessor 13 Nachrichten betreffend die Ausführungsbestätigung
des Geschäfts übermittelt werden; der Prozessor
13 sendet Bestätigungen der Transaktion aus und führt
die sonstigen erforderlichen Buchführungsfunktionen für das
Kundenkonta durch. Der Maklervertreter bzw. Angestellte des
Zweigbüros 27 i wird ebenfalls über die Verbindungsleitung 25
von der Ausführung der Order in Kenntnis gesetzt. Die Ordervariablen
CUSTID, SP, RN und RIGID dienen dem Zweck der
ordnungsgemäßen Verteilung des Handelsgeschäfts-Berichts, der
richtigen Errechnung der Provision u. dgl. Ferner wird der
Transaktionskurs typischerweise an das NASDAQ-System 18 sowie
an die verschiedenen Ticker-Dienste zwecks Berichterstattung
mitgeteilt. Die aktualisierten internen Makler-Variablen
(z. B. SSZ(STK), BSZ(STK), LPS(STK), PS(STK)) werden im
Speicher zur Verwendung bei späterten Order-Transaktionen
gespeichert (Schritt 127). Das Programm geht zum Block 130 und
aktualisiert die internen Management-Variablen wie die durchschnittlichen
Bestandskosten je Anteil AVCST(STK) des Maklers
sowie den Gewinn PR(STK) für die Aktie STK; dieser Datenverarbeitungsvorgang
wird unter Bezugnahme auf Fig. 4 und 4A
erläutert. Nach der Aktualisierung des Bestands und der
Gewinnabrechnung hört die Datenverarbeitung am Punkt 132 auf
und ist zur Abarbeitung des nächsten Handelsgeschäfts bereit.
Die Fig. 4 und 4A sind der linke und der rechte Abschnitt
eines Ablaufdiagramms für die Datenverarbeitung des Blocks 130
(Fig. 3) zur Aktualisierung der Bestandskosten (mittlerer
Anteilskurs AVCST(STK)) der Aktie STK und des laufenden
Gewinns PR(STK), der sich aus der Ausführung jedes Geschäfts
ergibt. Zu diesem Zweck wird das letzte Engagement des Maklers
LPS(STK) vor dem gerade ausgeführten Handelsgeschäft
geprüft und entschieden, ob der Makler vorher ein Hausse- oder
ein Baisse-Engagement in der Aktie STK hatte (Schritt 154).
Bei LPS(STK)0 handelt ess ich vorher um ein Hausse-
Engagement, und der Programmablauf geht zu Block 153,wo das
momentane Engagement (nach dem Handelsgeschäft) des Maklers
PS(STK) geprüft und entschieden wird, ob es ein Hausse-
Bestand (PS(STK)0?=J) oder ein Baisse-Bestand (N) ist.
Wenn der momentane Bestand des Maklers ein Baisse-Bestand ist
(N-Zweig), war die Transaktion ein Kundenkauf (da LPOS(STK)
ein Hausse-Bestand war), und das Programm zweigt zu Block 155
ab, um den Gewinn PR(STK) für die Aktie wie folgt zu aktualisieren:
PR(STK) = PR(STK) + (LP(STK) * (BSTA(STK) - AVCST(STK)) (1)
Auf der rechten Seite der Programmiervorschrift von Gleichung
(1) bezeichnet die Variable BSTA(STK) - AVCST(STK) die Gewinn-
oder Verlustspanne in bezug auf den Verkauf, nämlich die
Differenz zwischen dem laufenden Briefkurs BSTA(STK), zu dem
das Geschäft abgeschlossen wurde, und den durchschnittlichen
Kosten AVCST(STK) je Anteil der Aktie. Nach Multiplikation mit
der Anzahl Anteile, die sich vorher im Hausse-Bestand
(LPS(STK)) befanden, ist der auf das Pluszeichen in der
Vorschrift von Gleichung (1) folgende Faktor der Gewinn (oder
Verlust) für die Transaktion. Nach Addition zu dem vorhergehenden
laufenden Gesamtgewinn PR(STK) ist das in PR(STK)
gespeicherte Endergebnis ein aktualisierter laufender Gesamtbetrag
des Gewinns des Maklers in der Aktie STK, seit das
PR(STK)-Speicherfeldelement zuletzt gelöscht wurde.
Dann geht das Programm bei dem angenommenen Ereignis weiter zu
Block 156, wo die durchschnittlichen Kosten je Anteil des
neuen Baisse-Bestands der Aktie errechnet werden. In diesem
Fall sind die durchschnittlichen Kosten der Aktie gleich dem
gültigen Briefkurs, also AVCST(STK)=BSTA(STK). Der Programmablauf
von Fig. 4 endet dann am Punkt "Weitergehen".
Wenn im Block 153 der momentane Bestand des Maklers ein
Hausse-Bestand ist (PS(STK)0?=J), geht das Programm zum
Prüfschritt 160, wo das Kauf/Verkauf-Bit entscheidet, ob die
Transaktion ein Kauf oder Verkauf eines Kunden ist. Wenn das
Handelsgeschäft ein Kundenverkauf ist, wodurch der Hausse-
Bestand LPOS(STK) noch erhöht wird, handelt es sich um eine
Bestands-Transaktion, und das Programm zweigt zu Block 163 ab,
um die durchschnittlichen Kosten des STK-Aktienbestands zu
aktualisieren:

In Gleichung (2) bezeichnet NSH*BSTB(STK) die Kosten der
soeben vom Kunden gekauften Anteile, und
AVCST(STK)*LPS(STK) bezeichnet die Kosten des vorhergehenden
LPS(STK)-Bestands. Durch Division der Summe der neuen
und früheren Käufe durch die Anzahl gehaltener Anteile
PS(STK) werden die neuen durchschnittlichen Kosten
AVCST(STK) bestimmt.
Wenn im Block 160 entschieden wird, daß die Transaktion ein
Kundenkauf (Verkauf des Maklers) ist, geht das Programm zu
Block 166, wo der Gewinn des Maklers aktualisiert wird:
PR(STK) = PR(STK) + (NSH * (BSTA(STK) - AVCST(STK))) (3)
Bei dem Programmablauf von Fig. 4 wurden die drei Möglichkeiten
überprüft, beginnend mit dem Eintritt eines positiven
oder Hausse-Aktienbestands des Maklers in eine Transaktion
entsprechend den Inhalten von LPS(STK). Vergleichbare Funk
tionen laufen ab, wenn die Inhalte von LPS(STK) im Prüfschritt
150 negativ sind, was einen ursprünglichen Baisse-
Bestand (N-Ausgang der Prüfung 150) bedeutet. Unter der Annahme
eines solchen ursprünglichen Baisse-Bestands geht das
Programm zu dem Ablauf gemäß Fig. 4A, der analog zu dem
jenigen von Fig. 4 aufgebaut ist.
Eine Prüfung 170 in Fig. 4A entscheidet, ob der momentane
Bestand PS(STK) ein Baisse- oder Hausse-Bestand ist. Wenn
der momentane Bestand ebenfalls ein Baisse-Bestand ist
(PS(STK)<0), geht das Programm zu Block 172, wo das
Kauf/Verkauf-Bit ausgelesen wird. Wenn das Kauf/Verkauf-Bit
einen Kundenkauf signalisiert, ist die Transaktion eine Auf
füllung des Bestands (da der vorhergehende Baisse-Bestand in
LPS(STK) in PS(STK) erhöht wird), und das Programm
zweigt (J) zu Block 174 ab, wo die durchschnittlichen Kosten
der Aktie aktualisiert werden:

Wenn in Block 172 entschieden wird, daß die Transaktion ein
Verkauf ist, aktualisiert Block 175 den Gesamtgewinn:

Wenn schließlich in Block 170 der momentane Bestand des
Maklers ein Hausse-Bestand ist (PS(STK)<?=N), war die
Transaktion notwendigerweise ein Kundenverkauf (Kauf des
Maklers), und das Programm zweigt zu Block 176 ab, wo der
Gewinn PR(STK) aktualisiert wird:
PR(STK) = PR(STK) + (LPS(STK) * (BSTB(STK) - AVCST(STK))) (6)
Die durchschnittlichen Anteilskosten des neuen PS(STK)-
Baisse-Bestands sind der beste Geld- bzw. Transaktionskurs
(AVCST = BSTB(STK)) - Block 178. Damit ist die Gewinn- und
Kostenaktualisierung für die Transaktion abgeschlossen.
In den meisten Fällen ist es mehr als eine Institution, die
für eine bestimmte Aktie einen geordneten Markt in Gang hält.
Jeder Makler kann seinen Geld- oder Briefkurs zu jedem Zeitpunkt
ändern und die Änderung auf der Verbindungsleitung 16,
wie oben erwähnt, an das NASDAQ-System übermitteln. In einem
solchen Fall kann es erforderlich sein, die eigenen Notierungen
des Maklers zu aktualisieren, wenn z. B. die Änderung sich
auf den Freiverkehr auswirkt (bester Geld- und Briefkurs), so
daß dem Kunden die Ausführung zum besten herrschenden Kurs
ermöglicht wird. Fig. 5 zeigt die Datenverarbeitung bei Empfang
einer neuen Makler-Notierung vom NASDAQ-System 18. Beginnend
mit dem Unterbrechungs-Eingabepunkt 180 wird das System
in einen nichtautomatischen Ausführungsmodus gebracht (Schritt
182), der die automatische Ausführung von Orders für die
bestimmte Aktie (STK) verhindert, bis der Makler eine Möglichkeit
gehabt hat, auf die neuen Notierungen zu reagieren. Wenn
in Block 184 entschieden wird, daß sich der beste Geldkurs
BSTB(STK) oder der beste Briefkurs BSTA(STK) geändert hat,
geht das Programm zu Block 186, wo der beste Geldkurs
BSTB(STK) und/oder der beste Briefkurs BSTA(STK) auf die von
NASDAQ erhaltenen neuen Werte aktualisiert werden.
Dann findet eine Dialogkommunikation des Systems mit dem Händler
terminal 15 statt. Am Abschnitt T1 des Terminals 15 er
scheint ein Aufforderungszeichen, das die Eingabe hinsichtlich
möglicher Änderungen der höchsten annehmbaren Ordergröße
(RS(STK)), der Anzahl Anteile, die für Kundenkäufe verfügbar
sind (BSZ(STK)), sowie die Anzahl Anteile, die für Kunden
verkäufe verfügbar sind (SSZ(STK)), verlangt. Nach Eingabe der
verlangten Parameter (oder nach Initialisierung der Standard
annahmen) werden sämtliche vorher im Speicher gespeicherten
Orders erneut abgearbeitete (Block 190), da diese Orders nunmehr
aufgrund der Kursänderungen oder anderer Parameter zur
Ausführung qualifiziert sein können. Nachdem die gespeicherten
Orders überprüft und möglicherweise ausgeführt wurden, geht
die Datenverarbeitung wieder in den automatischen Modus über
(Block 192), indem etwa einfach eine Variable AUT in einen
vorbestimmten Zustand gesetzt wird (z. B. ′′AUT), und der
Unterbrechungsmodus endet am Punkt 194. Wenn in Block 184
entschieden wird, daß die Freiverkehrsnotierung durch die neue
Maklernotierung nicht geändert wurde, zweigt das Programm
direkt zu Block 192 ab unter Wiederherstellung des automatischen
Modus und Beendigung des Unterbrechungsmodus.
Das vorstehend erläuterte System kann somit automatisch einen
willkürlichen Echtzeit-Orderfluß für den Kauf und Verkauf von
Wertpapieren abarbeiten. Ankommende Orders werden zuerst
geprüft, um sicherzustellen, daß sie momentan gültigen Kriterien
hinsichtlich Wertpapierkursen, Aktien-Verfügbarkeit und
Aktien-Orderumfang entsprechen. Die unter den bestehenden
Kriterien qualifizierten Orders werden ausgeführt, und Gewinn-
und Bestandspreis-Speicherelemente des internen Managements
werden entsprechend aktualisiert, so daß sie die vom System
abgewickelten diversen Transaktionen reflektieren. Nicht für
die Ausführung qualifizierte Orders werden gespeichert und von
Zeit zu Zeit hinsichtlich einer möglichen späteren Ausführung
überprüft. Das System arbeitet automatisch ohne menschliches
Eingreifen, ausgenommen bei der Aktualisierung von gültigen
Orderqualifizierungskriterien des Maklers.
Claims (11)
1. Datenverarbeitungssystem für den Handel mit Wertpapieren,
bei dem dem Systemanwender die Aufrechterhaltung eines ge
ordneten Wertpapiermarktes ermöglicht wird, mit einer Auf
tragseingangseinrichtung zum Empfang von Kundenaufträgen für
mindestens ein Wertpapier, bei dem die Kundenaufträge Felder
zur Identifizierung des betreffenden Wertpapiers, eines Kauf-
und/oder Verkaufauftrags und der Anzahl der dem betreffenden
Auftrag zugrunde liegenden Wertpapiere aufweisen, mit einer
Speichereinrichtung zum Speichern von Kursinformationen
über Wertpapiere und von Auftragsqualifizierungsparametern, wie
verfügbare Wertpapiermengen des Systemanwenders, maximal
annehmbarer Auftragsumfänge und andere marktcharakteristische
Kriterien, mit einem Vergleicher zum Vergleichen der Kunden
aufträge mit den gespeicherten Kursinformationen und, als
Qualifizierungseinrichtung, zum Qualifizieren von Aufträgen
auch bezüglich anderer Auftragsqualifizierungsparameter,
mit einer Auftragsausführungseinrichtung zur Ermittlung des
Kurses und zur Ausführung von Kundenaufträgen und
mit einer Aktualisierungseinrichtung nach jedem ausgeführten
Auftrag durch Vermindern oder Erhöhen der Menge der Wertpapier
verkäufe bzw. -käufe in der Speichereinrichtung,
bei dem der Systemanwender auch als Eigentümer von Wertpapieren
als den Markt selbst mitgestaltender Prinzipal tätig werden
kann, indem er Wertpapiere an Systemkunden verkauft oder von
Systemkunden kauft,
dadurch gekennzeichnet,
daß die Speichereinrichtung Informationen über den Bestand, die
Position bzw. das Engagement (POS(STK)), die Kosten (AVCST(STK))
und den erwirtschafteten Gewinn (PR(STK)) sowie andere für den
internen Gebrauch des Prinzipals wichtige Daten bezüglich des
betreffenden Wertpapiers (STK) speichert und daß die Aktuali
sierungseinrichtung den Bestand bzw. die Position bzw. das Enga
gement (POS(STK)) des Prinzipals in der Speichereinrichtung
automatisch aktualisiert.
2. System nach Anspruch 1,
dadurch gekennzeichnet,
daß die Speichereinrichtung einen Auftrag ohne Ausführung
desselben speichert, wenn die Qualifizierungseinrichtung
aufgrund der Auftragsqualifizierungsparameter den Auftrag
nicht zur Ausführung freigibt.
3. System nach Anspruch 1 oder 2,
dadurch gekennzeichnet,
daß die Aktualisierungseinrichtung bei Ausführung eines
Auftrags wenigstens entweder die gespeicherten Kosten oder
den gespeicherten Gewinn aktualisiert.
4. System nach einem der vorhergehenden Ansprüche,
dadurch gekennzeichnet,
daß die Qualifizierungseinrichtung einen in der Speicherein
richtung gespeicherten Auftrag zur Ausführung freigibt, wenn
die durch die Aktualisierungseinrichtung aktualisierten
Auftragsqualifizierungsparameter des betreffenden Wertpapiers
eine Auftragsausführung gestatten.
5. System nach einem der vorhergehenden Ansprüche,
dadurch gekennzeichnet,
daß die gespeicherten Auftragsqualifizierungsparameter eine
Höchstmenge des wenigstens einen Wertpapiers, die für einen
einzigen Kundenauftrag annehmbar ist, umfassen.
6. System nach einem der vorhergehenden Ansprüche,
dadurch gekennzeichnet,
daß die Felde der Kundenaufträge ferner Information enthalten,

7. System nach einem der vorhergehenden Ansprüche,
dadurch gekennzeichnet,
daß die Speichereinrichtung den letzten Bestand des wenigstens
einen Wertpapiers speichert, und daß die Aktualisierungs
einrichtung den Gewinn einer ausgeführten Transaktion er
rechnet und den Bestand relativ zu dem gespeicherten letzten
Bestand algebraisch in Richtung auf Null oder auf der Zahlen
geraden über Null hinaus reduziert.
8. System nach einem der vorhergehenden Ansprüche,
dadurch gekennzeichnet,
daß die Aktualisierungseinrichtung die durchschnittlichen
Kosten je Aktienanteil in dem Bestand aktualisiert.
9. System nach einem der vorhergehenden Ansprüche,
dadurch gekennzeichnet,
daß Unterbrechungsmittel die Datenverarbeitung bei Auffinden
einer Geld- oder Briefkursänderung anhalten, daß
die Aktualisierungseinrichtung die Geld- und Briefkurse
bei Empfang eines neuen gültigen Geld- oder Briefkurses
für das wenigstens eine Wertpapier aktualisiert, daß
Dialogmittel die manuelle Eingabe von aktualisierten Auftrags-
Qualifizierungs-Parametern ermöglichen, und daß
die Auftragsausführungseinrichtung die nicht ausgeführten
gespeicherten Aufträge abarbeitet.
10. System nach einem der vorhergehenden Ansprüche,
gekennzeichnet durch
eine Übertragungseinrichtung zur Übertragung von Information
bezüglich ausgeführter Aufträge zu weiteren Datenver
arbeitungseinrichtungen.
11. System nach einem der vorhergehenden Ansprüche,
dadurch gekennzeichnet,
daß die Auftragseingangseinrichtung zum Empfang von Aufträgen
sowohl Zweigbüro- als auch Drittunternehmen-Orderursprungsmittel
(27₁, 27 i) sowie Verbindungsnetze (25, 26)
umfassen, die die Orderursprungsmittel mit dem Daten
verarbeitungssystem verbinden.
